General terms and conditions Unique Beauty Studio & Academy
1. General Our general terms and conditions apply to every offer, treatment and transaction between Unique Beauty Studio and a client for which Unique Beauty Studio has drawn up these conditions, insofar as the parties have not expressly deviated from these conditions in writing.
2. Beauty salon efforts1. Unique Beauty Studio will carry out all treatments to the best of its knowledge and ability and in accordance with the requirements of good workmanship.2. The client ensures that all information that may reasonably be important for the proper implementation of the treatment is provided to the employee in a timely manner.3. Unique Beauty Studio is not liable for damage of any nature caused by the client providing incorrect and/or incomplete information to our employees that is important for the treatment. 4. Unique Beauty Studio will inform the client of the financial consequences of the change in treatment.
3. Agreements1. The client must notify Unique Beauty Studio of any impediment to an appointment as soon as possible and no later than twenty-four hours prior to the appointment. This can be done by telephone or email. 2. If the client does not comply with this obligation or does not comply on time, Unique Beauty Studio may charge the entire amount for the agreed treatment to the client.3. If the client arrives at the salon more than five minutes later than the agreed time, the treatment may no longer be carried out or the late arrival may be deducted from the treatment time. The client will be charged the full amount. 4. If the client arrives at the salon more than fifteen minutes later than the agreed time, the employee may cancel the entire appointment if there is no more time to carry out the treatment. The entire amount will be charged to the client. 5. Both parties do not have to comply with the obligations of Articles 3.1 to 3.5 if they are hindered by force majeure. Force majeure includes what the law and case law says about it.
4. Personal data & privacy1. Before the first treatment, the client provides the employee with all information that the employee indicates is necessary or which the client should reasonably understand is necessary for the careful execution of the treatments.2. The employee records the client's personal data and processes it in a customer file.3. Unique Beauty Studio treats the client's confidential data in accordance with the guidelines in the Personal Data Protection Act.4. Unique Beauty Studio will not sell or rent client data to third parties.
5. Payment1. Unique Beauty Studio lists all prices of the treatments and products visible in the salon and on the website.2. The reported prices include 21% VAT.3. Offers in advertisements are valid for the stated period and/or while supplies last.4. The client must pay for the treatment and any products immediately after the treatment by cash, debit card or bank transfer.5. All prices shown on this site are subject to change and/or errors.
6. Liability1. Unique Beauty Studio is not liable for damage of any kind caused by the fact that the Unique Beauty Studio employee relied on incorrect and/or incomplete information provided by the client about physical conditions, medication use, work, leisure activities.2. Unique Beauty Studio is not liable for loss, theft, or damage to personal property that the client has brought to the salon.7. Complaints1. If the client has a complaint about the treatment or a product, the complaint must be reported both orally and in writing to the owner of Unique Beauty Studio as soon as possible, and no later than within two weeks after discovery.2. Unique Beauty Studio must have adequately dealt with the complaint within 5 working days and must respond to the client.3. If a complaint about the treatments is justified, Unique Beauty Studio will perform the treatment again as agreed, unless this has demonstrably become pointless for the client and the client makes this known in writing.4. If a complaint about the products is justified, Unique Beauty Studio will replace the product or partially or fully refund the purchase price of the products.5. If Unique Beauty Studio and the client cannot reach an agreement, the complainant can submit the dispute to the legislator or mediator.
8. Warranty1. Unique Beauty Studio gives the client a one-week (7 days) guarantee on the treatment and products.2. After a treatment, the skin may react. The client will be informed of this during the treatment.3. This warranty is void if:4. The client has been informed by the employee about the result of the treatment and the duration of the effect of the treatment or products;5. The client has used products other than those recommended by the employee;6. The client has not followed the advice for home care;7. The client has not followed the advice to seek medical help within five working days;8. The client has not used the products according to the employee's advice;9. The client has not used the products according to the instructions for use.9. Confidentiality1. Unique Beauty Studio is obliged to maintain confidentiality of all confidential information provided by the client during the treatment.2. Information is considered confidential if this has been told by the client or if this arises from the nature of the information.3. Confidentiality lapses if the employee is obliged to provide confidential information to third parties on the basis of a legal provision or a legal ruling.
10. Damage and/or theft1. Unique Beauty Studio has the right to demand compensation from the client if the client damages furniture, equipment or products.2. Unique Beauty Studio always reports theft to the police.
11. Proper behavior 1. The client should behave in the salon according to generally accepted standards.2. If the client continues to exhibit inappropriate behavior after repeated warnings, Unique Beauty Studio has the right to refuse the client access to the salon without further stating reasons.3. At Unique Beauty Studio we work according to the hygiene rules of the HAM code of beauticians.
12. Law1. Dutch law applies to every agreement between Unique Beauty Studio and the client.2. The general terms and conditions are published on the Unique Beauty Studio website and are also available in the salon.3. In the event of an explanation of the content and scope of the general terms and conditions, the Dutch text is always decisive.4. The most recently published version or the version that applied at the time the agreement was concluded always applies.
